Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a commercial cannabis cultivation license. The applicant proposes to operate a Medium Outdoor license located at 363 STEEDS WAY MOUNTAIN RANCH. A total permitted canopy of 33,375 square feet is divided into three outdoor cultivation areas (A, B, and C). Plants are grown in native soil and fabric smart pots arranged in rows with 6-foot minimum walkways. No indoor cultivation, manufacturing, processing, distribution, or retail sales activities are proposed or will occur on site. All harvested materials are removed from the premises the same day as harvest and transported to licensed off-site processing facilities. The subject property is a 217-acre parcel located in the Agricultural (A1) zone. The property was historically used as a goat farm and general rural agricultural operation. DCC24-0038

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. Calaveras County Board of Supervisors certified an Environmental Impact Report (EIR) for the Medical Cannabis Cultivation and Commerce Ordinance Project in January 2018. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
