Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake Alteration Agreement EPIMS Notification Number SJN-64841-R2, pursuant to Section 1602 of the Fish and Game Code to the project Applicant, Port of Stockton as represented by Jason Cashman. The project is limited to the maintenance dredging within a portion of McLeod Lake measuring approximately 11.2 acres to a maximum depth of 3 feet in order to remove a total of 54,900 cubic yards of sediment containing cyanobacteria seed stocks, legacy organic carbon, and internal nutrient loads. Sediments will be deposited on Roberts Island, an area previously utilized for sediment disposal from maintenance dredging of the nearby Stockton Deep Water Ship Channel.

Reasons for Exemption
On April 21, 2026, the Port of Stockton, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, section. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
