Reasons for Exemption
This action is consistent with Section 15061 (b)(3), The Common Sense Rule, whereas the allowance to update the site plan can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This is because the Minor Modification is merely updating Special Use Permit No. PSP 06-052 (ZA) to make the temporary solid waste recycling permanent to the existing established Recycling Facility, in the M-1(Light Manufacturing) zone, within the Porterville Urban Area Boundary, with the Land Use Designation of Industrial. The use has already been through a CEQA review by way of an approved Categorical Exemption, that was approved by the Tulare County Zoning Administrator, Decision No. 2907, which was recorded on May 15, 2008, Recording Document No. 2008-0034882. Therefore, the application of CEQA Section 15061(b)(3) is applicable and appropriate for this project.
