Reasons for Exemption
This action is consistent with Section 15061(b)(3), The Common Sense Rule, as well as CEQA Guideline Class 3, Section 15303, which pertains to the construction or conversion of small structures. The proposed Minor Modification involves an update to the approved site plan to allow for the addition of a new maintenance shop within the existing calf-raising facility. This building will serve as accessory storage and will not alter the established operations, nor will it expand the facility’s functional footprint in a way that would increase environmental impacts. It can be seen with certainty that there is no possibility that the proposed activity may have a significant effect on the environment. Therefore, the project is not subject to CEQA. The proposed modification will not result in any changes to the number of employees, days or hours of operation, types of equipment or machinery utilized, parking (including the number of stalls, their location, size, or type of surfacing), traffic circulation, previously imposed conditions of approval, or the overall intensity of the existing use. The Minor Modification applies to an existing, legally established calf-raising facility located in the AE-40 (Exclusive Agriculture – 40 Acre Minimum) Zone within the Rural Valley Lands Plan, designated Valley Agriculture by the General Plan. The original use was reviewed under Special Use Permit No. PSP 96-019 (PC), which received environmental clearance through an approved Negative Declaration adopted by the Tulare County Planning Commission on September 26, 1991 (Decision No. 1391). Therefore, the application of CEQA Section 15061(b)(3) and CEQA Guideline Class 3, Section 15303 is both applicable and appropriate for this project, as the proposed modification represents a minor, accessory addition to an existing approved use with no potential for new or increased environmental effects
