Document Description
The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under Division 4.5, California Code of Regulations, Title 22, Chapter 20 prepared an approval for a Hazardous Waste Facility Operation Permit and Post Closure Permit (HWF Permit) pursuant to California Health and Safety Code section 25200 for ten years at the Ecobat Resources, Inc. (formerly Quemetco Inc.) Facility (Facility) located at 720 South 7th Avenue in Industry, CA 91746. The renewal would be accomplished by approving a split of the HWF Permit into two separate hazardous waste facility permits (one Operation Permit and one Post-Closure Permit). The Addendum to the previously certified 2005 Final Environmental Impact Report (State Clearinghouse No. 1996041042) was prepared to evaluate activities associated with continued Facility operation via the HWF Permit renewal, and minor modifications to the Facility and additional demolition during closure, via issuance of the Operation Permit and the Post-Closure Permit (the Project). The Project authorizes the following:
a. Continuation of Facility operations via renewal of the existing Resource Recovery and Conservation Act (RCRA) Hazardous Waste Operation and Post Closure Permits for the Facility. The renewal is accomplished by approving a split of the existing HWF Permit into two separate hazardous waste facility permits (one Operation Permit and one Post-Closure Permit). The Operation Permit will have a term of 5 years, and the Post-Closure Permit will have a term of 10 years;
b. Continuance of the treatment, storage and handling of hazardous wastes and hazardous materials to allow continued recovery and recycling of lead from lead acid batteries and other secondary sources (no capacity upgrades would be authorized under either of the new Permits); and
c. Continued implementation of Post Closure Plan, including cover maintenance, security, groundwater monitoring and storm/surface water management.
2. Modify the Closure Plan to include demolition of Battery Wrecker and Containment Building.
3. Minor Facility Modifications (described below) (Operation Permit only):
a. Install sump and power pump to the secondary containment of the battery storage area;
b. Remove sacrificial layer and floor in the containment building;
c. Install new floor and leak detection system in the containment building;
d. Perform corrective actions on tanks;
e. Increase the height of wastewater treatment plant (WWTP) berm; and
operate two miscellaneous units, consisting of a centrifuge and compression auger (dewatering equipment) to remove free liquids.
The Facility Modifications aid in the improvement of containment measures to prevent any releases which prevent the potential for any adverse effects on human health and the environment due to migration of waste constituents, hazardous constituents, or reaction products in the groundwater, subsurface environment, surface water, or on the soil surface. All proposed Facility Modifications are intended to prevent and minimize the release or threat of release of hazardous waste for protection of the environment.
The Project would involve continuation of activities and operations (with changes as described above) that were previously evaluated in the 2005 Final EIR and previously approved. The continuation of the Hazardous Waste Facility Operation Permit and Post Closure Permit would not result in new or substantially more severe significant impacts on the environment. ll proposed Facility Modifications are intended to prevent and minimize the release or threat of release of hazardous waste for protection of the environment.
As Lead Agency under the California Environmental Quality Act (CEQA), DTSC approved the above-described project on November 21, 2025, and has made the following determinations:
1. The project will not have a significant effect on the environment.
2. An Environmental Impact Report was prepared for this project pursuant to the provisions of CEQA.
3. Mitigation measures were made a condition of project approval by DTSC.
4. A mitigation reporting or monitoring plan was adopted for this project by DTSC.
5. A Statement of Overriding Considerations was not adopted for this project by DTSC.
6. Findings were made pursuant to the provisions of CEQA by DTSC.
