Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 4, Section 15304
Reasons for Exemption
Staff has found the project consistent with CMC 14.18.180(A)(1), that the Bradford Pear tree interferes with private on-site utility services and cannot be controlled or remedied through reasonable relocation or modification of the structure or utility services. The Cupertino Sanitary District requires the removal of the tree to make necessary repairs to the sanitary sewer line located a few inches from the base of the tree. The repairs to the sanitary sewer line require that a 10’ deep, 3’ wide and 8’ long trench be dug and the District contractor has confirmed they cannot hand dig around the base of the tree.
