Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
14 CCR 15302 Class 02 (c): Replacement or Reconstruction
Reasons for Exemption
California Code of Regulations, Title 14 Section 15302 Class 2 exemptions apply to the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Examples include but are not limited to: (c) Replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity. The project involves the construction of a new groundwater production well, Well E9AW, to replace the former Well E9W, an existing public water supply well that was permanently removed from service after a casing collapse rendered it inoperable. The replacement well will be constructed on the same City-owned parcel as the former well, offset only as necessary to avoid interference with the collapsed borehole, and will serve the same purpose as a groundwater production source for the City's existing public water system. The proposed production capacity of Well E9 AW is intended to restore the historical production capacity of the site, which had declined as the former well aged. Since the project replaces an existing public utility facility on the same site, serves substantially the same purpose and capacity as the facility being replaced, and does not expand the City's existing water service area or overall water system capacity beyond the pre-existing condition, the project is categorically exempt from environmental review pursuant to CEQA Guidelines Section I 5302 Class 2: Replacement or Reconstruction.
