Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Categorical Exemption (Sec. 15301)
Reasons for Exemption
The Project proposes minor alteration to an existing private water storage facility, including installation of new PFAS water treatment system, consisting of two Granular Activated Carbon (GAC) vessels with associated control/electrical systems, underground utilities, and piping connections. These improvements support existing water utility operations and would not expand the facility’s capacity or service area, intensify operations beyond typical activity levels, or change the underlying operational purpose of the facility. Therefore, the Project qualifies for a categorical exemption under CEQA Guidelines Section 15301.
Exceptions - Section 15300.2
None of the exceptions to the categorical exemption listed in CEQA Guidelines Section
15300.2 apply, as described below.
1. Location. This exception does not apply to Class 1 exemptions. No analysis is required.
2. Cumulative Impact. The Project is limited in scope and would not authorize or induce additional development nor would it expand or substantially increase the intensity of use of the existing water utility facility. There are no known successive projects of the same type in the same place that, in combination with the Project, would result in significant cumulative impacts. Accordingly, the cumulative impact exception does not apply.
3. Significant Effects Resulting from Unusual Circumstances. The Project's physical improvements and operational characteristics are consistent with the continued use and minor modification of an existing water utility facility. The installation of PFAS treatment equipment would not, in itself, establish unusual circumstances. There is no evidence indicating a reasonable possibility that unusual circumstances exist or that the Project would result in a significant environmental effect due to unusual circumstances. Accordingly, the unusual circumstances exception does not apply.
4. Scenic Highways. The Project site is not located within or adjacent to a highway eligible or officially designated as a Scenic Highway by the California Department of Transportation. No damage to scenic resources within a designated state scenic highway would occur. Accordingly, the scenic highways exception does not apply.
5. Hazardous Waste Sites. The Project site is not included on the list of hazardous waste facilities compiled pursuant to California Government Code Section 65962.5, including the list of Hazardous Waste and Substances sites from the Department of Toxic Substances Control (DTSC) EnviroStor database; the list of Leaking Underground Storage Tank (LUST) sites from the State Water Resource Control Board (SWRCB) Geotracker database; the list of solid waste disposal sites identified by the SWRCB with waste constituents above hazardous waste levels outside the waste management list; the list of active Cease and Desist Orders or Cleanup and Abatement Orders that concern the discharge of wastes that are hazardous materials; or the list of hazardous waste facilities subject to corrective action pursuant to Section 25187.5 of the Health and Safety Code identified by DTSC. Accordingly, the hazardous waste exception does not apply.
6. Historical Resources. The Project site does not contain any resource listed in Livermore's 2021 Historic Resources Inventory, the California Register of Historical Resources, or the National Register of Historic Places. As such, no historical resources have been identified that would be adversely affected by the Project. Accordingly, the historical resources exception does not apply.
