Notice of Exemption
Exempt Status
Statutory Exemption
Type, Section or Code
CEQA Guidelines Section15061(b)(3), Common Sense Exemption
Reasons for Exemption
This project is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. A pre-activity survey and review of the CNDDB was completed by Kevin Merck Associates, LLC (KMA) No special status wildlife were observed, no large stick nests indicative of raptors. The creek channel supported aquatic habitat with little flow and no special status amphibians or reptiles were observed in the creek channel or surrounding 200-500 feet of riparian habitat. KMA will provide biological monitoring during all on-site activity to ensure vegetation management avoids special status species should they be present. With that, it can be seen with certainty that there is no possibility that this project may have a significant effect on the environment therefore, the activity is not subject to CEQA.
