Reasons for Exemption
:After reviewing the project and its setting, the Environmental Coordinator for the County of Tuolumne has determined that the project is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines because the activity is covered by the general rule (common sense) exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The project involves a General Plan Amendment and Zone Change affecting six parcels to establish consistent General Commercial land use designations and C-1 (General Commercial) zoning. No grading, construction, site disturbance, or site-specific development is proposed as part of this application, and no onsite roads, infrastructure, or utilities are proposed. Future development of the project site would require separate review and approvals and would be subject to environmental review, as applicable. The proposed legislative actions do not result in a material increase in development potential beyond what is currently allowed and would not result in any significant physical environmental effects. The CEQA Guidelines contain exceptions that, if present on a project site, prevent a project from proceeding with an exemption. These exceptions are listed in Section 15300.2 of the State CEQA Guidelines and include situations such as a project resulting in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway, having documented hazardous waste on the site, impacts to historical resources, cumulative impacts, or presence of a particularly sensitive environment. None of the exceptions listed in Section 15300.2 apply to this project.
