The Finding of Conformity is exempt from the California Environmental Quality Act (“CEQA”) Guidelines Section 15061(b)(3) (Common Sense Exemption), which states that an activity is covered by the common sense exemption that CEQA only applies to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA review. The adoption of the Finding of Conformity is limited to legal findings and will not result in a physical change in the environment and none of the exceptions under CEQA Guidelines Section 15300.2 apply.
