CEQA Guidelines Section 15061(b)(3)
Reasons for Exemption
The SB 79 amendments, including the Zoning Map amendment, are exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), the common-sense exemption, which provides that CEQA applies only to projects that have the potential to cause a significant effect on the environment. The amendment does not approve any physical development, increase development intensity, change existing land use designations, or modify underlying zoning regulations or development standards. As a separate and independent basis, Government Code Section 65912.160(c)(2) states that an ordinance consistent with the provisions of SB 79 shall not be considered a project under CEQA.
