Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Exemption Section 15301 (Class 1. Existing Facilities)
Reasons for Exemption
Reasons why project is exempt: In accordance with the California Environmental Quality Act (CEQA), the project has been reviewed pursuant to State CEQA Guidelines Section 15002(k) – General Concepts, the three-step process for determining the appropriate environmental review documents for a project subject to CEQA and Section 15061 – Review for Exemption, the procedures for determining if a project is exempt from CEQA. State CEQA Guidelines Categorical Exemption Section 15301 (Class 1. Existing Facilities). The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project involves removing an existing 60-foot-long x 14-foot-wide floating boat dock to allow for offsite maintenance and repairs. Once repairs are completed, the dock will be placed back between the pilings, and the metal brackets will be welded back into place, involving negligible or no expansion of former use. Furthermore, the Port has determined that none of the exemptions to the exceptions set forth in State CEQA Guidelines Section 15300.2 foreclose the use of the categorical exemption in Section 15301. Therefore, the project is exempt from CEQA and no further environmental review is required.
