Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Section 15301, Existing Facilities
Reasons for Exemption
This action is exempt from CEQA pursuant to Section 15301, Existing Facilities, because by this action no changes to any structures are contemplated and the action will not alter existing District operations or obligations. The District has not been providing any services to these lands for over one year, which services the State is providing instead. The State has assumed responsibility for the operation and maintenance of the levees surrounding this area, so there will be no change in services.

Type, Section or Code
CEQA Guidelines Section 15061 b(3) General Rule Exemption
Reasons for Exemption
This action is exempt pursuant to Section 15061 b(3) because this action is covered by the general rule that CEQA applies only to a project which has the potential for causing a significant effect on the environment. The District is applying to have its boundaries changed since the State is now responsible to operate and maintain this levee system, thus operation and maintenance will continue as before, but simply by a different agency. The boundary change will not make any changes in the uses to which the land involved might be put and is not a necessary step in the development of the land. (Simi Valley Recreation & Park Dist. v. Local Agency Formation Comm. (1975) 51 Cal.App.3d 648, 665-666.) The District has no general land use authority, is not proposing to alter land use, and therefore there is no possibility that this activity may have a significant effect on the environment. The District also finds there is no evidence in the record that an unusual circumstance exists with respect to this action.
