Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Section 15301
Reasons for Exemption
Section 15301 of the CEQA Guidelines exempts from CEQA review projects that consist “of the operation, repair, maintenance…or minor alteration of existing public or private structures….” The key consideration is whether the project involves negligible or no expansion of use. The exemption includes enumerated examples, including without limitation, projects involving “existing highways and streets….” The proposed action is the approval of FMAs to provide for the maintenance of existing overpasses by the County and Caltrans. Since the project provides for the maintenance of existing structures with no expansion of use, it is properly found to be exempt from CEQA review by Section 15301 of the CEQA Guidelines.
