Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-CCA-63257-R3, pursuant to Section 1602 of the Fish and Game Code to Friends of Alhambra Creek, as represented by Bob Huttar. The project will remove 36 stands of Arundo, up to 5 acres in area, to improve habitat for native plant and wildlife species. Arundo will be removed using hand tools to cut the stems close to the ground, then applying an aquatic-approved herbicide to the stumps. There will be no physical removal of rhizomes or roots to minimize erosion. Impacts to native riparian trees and vegetation will be minimized by limiting site access points, localizing herbicide application, and using plywood ground coverings and extension ladders to protect soil and roots. Multiple treatments over subsequent years may be required.

Reasons for Exemption
On December 19, 2025, the Contra Costa Resource Conservation District (CCRCD), the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, section 15333. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
