Reasons for Exemption
The request to approve modification of a condition of approval (Condition No. 13 of Development Review No. DRP21-0065) to allow defined flexibility in authorization of use of the building rather than restriction of floor area by operational character was reviewed for applicable exemptions and was found to satisfy the requirements of a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the California Environmental Quality Act (CEQA) since the project involves only minor language changes, the operations will be conducted in compliance with all other conditions of approval and mitigation measures adopted for the existing commercial facility and that there will be negligible or no expansion of the existing or former use.
