On May 15, 2019, the City Council adopted a Mitigated Negative Declaration for the Affresco West project in connection with its approval of Tentative Tract Map No. 37447 and the related project entitlements. The requested extension only extends the expiration date of Tentative Tract Map No. 37447 and does not modify the approved map, project design, density, land uses, improvements, conditions of approval, or mitigation measures. Accordingly, no subsequent
environmental impact report or negative declaration is required pursuant to CEQA Guidelines section 15162. All previously adopted mitigation measures remain applicable and enforceable.

Alternatively and independently, the requested extension is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) because this action will not have the potential to cause a significant effect on the environment as the resolution only extends the expiration of a previously approved land use entitlement that was previously analyzed in conformance with CEQA.
