Common Sense Exemption: CEQA Guidelines §15061(b)(3)
Reasons for Exemption
T CEQA Guidelines §15061(b)(3) provides that an activity is exempt where it can be seen with certainty that there is no possibility the activity may have a significant effect on the environment. MIM 26-034 only acknowledges the continued lawful operation of an existing convenience market as a pre-existing/grandfathered use; it does not authorize construction, expansion, intensification, or other physical change. Accordingly, the common sense exemption applies. The action is also categorically exempt under CEQA Guidelines §15301, Class 1, Existing Facilities, which applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private facilities involving negligible or no expansion of existing or former use. The determination concerns continued operation of the existing convenience market with no expansion of use authorized by this action. The County has considered the exceptions in CEQA Guidelines §15300.2 and determined that none apply. This NOE is limited to the grandfathering determination; any future physical improvements are not approved by MIM 26-034 and would be subject to separate permit and CEQA review, as applicable.
