Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Section 15315 - Class 15 “Minor Land Divisions”
Reasons for Exemption
Under the California Environmental Quality Act (CEQA), CEQA Guidelines Section 15315 (Class 15, “Minor Land Divisions”) exempts the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division conforms to the General Plan and zoning, requires no variances or exceptions, has adequate services and access to the proposed parcels, does not involve a parcel divided from a larger parcel within the previous two years, and does not have an average slope greater than 20 percent. The Project proposes to subdivide a developed 7.502-acre parcel in an urbanized area zoned Regional Commercial into four parcels, with no additional development. The Project conforms to the General Plan and zoning, requires no variances or exceptions, is adequately served by utilities and public services, and would not result in significant impacts related to traffic, noise, air quality, or water quality. The parcel was last divided on July 22, 1981, more than two years ago, and has an average slope of approximately 1 percent, below the 20-percent threshold. None of the exceptions to categorical exemptions under CEQA Guidelines Section 15300.2 apply because the Project Site is not located in a particularly sensitive environmental area and involves rehabilitation of an existing developed site; the Project would not result in cumulatively considerable impacts or significant adverse environmental effects due to unusual circumstances; the site is not within a designated scenic highway corridor and would not damage scenic resources; the site is not listed pursuant to Government Code Section 65962.5 and no known hazardous materials conditions would be exacerbated; and the Project would not cause a substantial adverse change in the significance of a historical resource under CEQA Guidelines Sections 15064.5 and 15300.2(f).
