Reasons for Exemption
Section 15301 of the State California Environmental Quality Act (CEQA) Guidelines categorically exempts from CEQA review the “operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use.” The Encinitas Burn Site Sewer Replacement Project (Project) consists of excavation, hauling off-site disposal of up to 880 tons of materials and replacement of 700 ft of sewer pipeline. The goal of the project is to repair and replace 700 feet of sewer line to its original condition. Therefore, the action relates to the minor alteration of an existing publicly owned facility involving no or negligible or no expansion of existing or former use, and is, accordingly, categorically exempt from CEQA review pursuant to Section 15301 of the CEQA Guidelines.
