Document Description
Special Use Permit No. PSP 26-049 (AA) would allow construction of one new approximately 2,500-square-foot single-family residence as a second residence on a 4.79-acre parcel in the AE-10 (Exclusive Agriculture – 10 Acre Minimum) Zone, within the Rural Valley Lands Plan and Valley Agriculture land use designation. The parcel is already developed with an existing residence, domestic well, onsite wastewater treatment system (OWTS)/septic system, and accessory structures. The new residence would use an approved OWTS arrangement, consisting of either a new system or an appropriately certified/expanded existing system, as required by Tulare County Environmental Health, together with normal residential utility connections and site improvements. The Project would not change the existing zoning or General Plan land use designation.

Reasons for Exemption
The Project is categorically exempt pursuant to CEQA Guidelines §15303, Class 3, New Construction or Conversion of Small Structures. Section 15303(a) applies to construction of one single-family residence. The Project authorizes one new approximately 2,500-square-foot single-family residence on an already developed parcel containing an existing residence, domestic well, OWTS/septic system, and accessory structures. Section 15303(d) also applies to utility extensions of reasonable length needed to serve such construction, including associated water, wastewater, electrical, and similar connections. The Project does not involve a change in zoning or land use designation. Based on the administrative record, including the existing developed condition of the parcel and agency consultation, there is no evidence that any of the exceptions to the use of a categorical exemption in CEQA Guidelines §15300.2 apply. Therefore, the County concludes that Class 3 is applicable and appropriate for the Project.
