Reasons for Exemption
Under the California Environmental Quality Act (CEQA), the State CEQA Guidelines identify classes of projects that have been determined not to have a significant effect on the environment and are therefore exempt from CEQA review. Section 15303(e) (Class 3, “New Construction or Conversion of Small Structures”) of the CEQA Guidelines exempts the construction and location of limited numbers of new, small facilities or structures, including accessory (appurtenant) structures such as fences/walls.
Moreover, none of the exceptions listed in CEQA Guidelines, Section 15300.2 apply, in that: (a) the site is not located in an environmentally sensitive area, (b) there are no cumulative impacts, (c) there are no significant effects due to unusual circumstances, (d) the project is not located near a scenic highway, (e) the project site is not located on a hazardous waste site pursuant to Government Code Section 65962.5, and (f) the project would not adversely affect any historical resource.
