Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 15, Section 15315, Minor Land Divisions
Reasons for Exemption
The project qualifies for an Assembly Bill (AB) 130 Statutory Exemption pursuant to Public Resources Code Section 21080.66 (Infill Housing Projects) and Class 15 – Minor Land Divisions Categorical Exemption under the California Environmental Quality Act (CEQA) (Public Resources Code, Sections 21000-21189.57) as set forth in Sections 15315 and 15300.2 of the State CEQA Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000-15387). The Class 15 Categorical Exemption consists of the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcels were not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent. The proposed project is a request to subdivide the property into a one-lot map for condominium purposes, and the subject site is located in an urbanized area within the Industrial zone and is designated for Mixed-Use High land uses in the General Plan, which permits residential uses consistent with the corresponding Mixed-Use implementing zone. The proposed subdivision would be in conformance with the General Plan and applicable development standards, with the exception of those that are granted under State Density Bonus law. Demolition of existing structures, ornamental landscaping, and associated parking areas will be required to accommodate future residential development. Under subsection 18.10.030.105, the Code permits by right single-family attached developments in the Industrial Zone on properties with a Residential or Mixed-Use General Plan land use designation, subject to the permitted uses and development standards of the applicable implementing zone identified in the General Plan. As such, the future residential development would be considered to be a ministerial project, therefore no further CEQA analysis, documentation, or environmental determination is required pursuant to Public Resources Code Section 21080(b)(1) Section 15268 of the CEQA Guidelines. Future improvements will require issuance of construction permits to demonstrate compliance with all applicable State and City codes, standards, and policies. All services and access to the property would be provided in accordance with local standards, the property was not involved in the division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent and the project therefore consistent with this type of exemption. Pursuant to Sections 15315 and 15300.2 of the CEQA Guidelines, no exceptions to the exemption apply, there are no unusual circumstances in respect to the project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is exempt from the provisions of CEQA.

Exempt Status
Statutory Exemption
Type, Section or Code
Assembly Bill (AB) 130, Public Resources Code Section 21080.66 (Infill Housing Projects)
Reasons for Exemption
The Statutory Exemption established by AB 130 (Public Resources Code Section 21080.66) applies to qualifying infill housing development projects that satisfy specified eligibility criteria related to project characteristics, urban infill location, land use consistency, environmental constraints, infrastructure availability, and procedural requirements including Native American tribal consultation. The proposed project satisfies the eligibility criteria because it consists of a residential development on a 3.02-acre urban infill site, exceeds the minimum residential density required by the statute of 15 dwelling units per acre, is consistent with the Mixed-Use High General Plan designation and applicable implementing zone, and is served by existing public infrastructure and services. In addition, the project site is not located within the Coastal Zone, on protected agricultural land, wetlands, a high fire hazard severity zone, a state responsibility area, a Cortese listed site, an earthquake fault zone, a special flood hazard area, lands identified for conservation, habitat for protected species, or lands subject to a conservation easement. The project would not demolish a historic resource, includes no hotel, motel, bed and breakfast inn, or other transient lodging, is located more than 500 feet from a freeway, and the required Native American tribal consultation process has been completed with incorporation of necessary project conditions. Therefore, the proposed project satisfies the applicable eligibility criteria of California Public Resources Code Section 21080.66 and qualifies for the Statutory Exemption from CEQA.
