Document Description
The Project involves rehabilitating (i.e., removing and replacing) approximately 200,000 square-feet (sf) of existing asphalt-paved access roadways, parking areas, and paved areas surrounding tanks and equipment at CLAWA’s active Silverwood Lake WTP. The existing pavement is in poor condition and exhibits alligator cracking, oxidation, deteriorated asphalt binder, and previous utility-trench repairs. Depending on pavement and subgrade conditions, the work may include grinding and asphalt overlay, full-depth pavement reconstruction, localized pavement repairs, utility-trench pavement repairs, and subgrade stabilization. Pavement elevations would remain close to existing conditions. Construction staging will stay within the limits of the WTP on pavement. Construction will be completed in phases to maintain access for facility operations, maintenance and emergency vehicles, deliveries, and equipment servicing. The Project also includes installing two 4-inch-diameter PVC conduits extending approximately 315 linear feet to provide a sleeve for chemical injection tubing between two existing subsurface vaults. The alignment of the conduits is located where there is existing asphalt pavement slated for rehabilitation. Open trenching will be used for installation. Construction staging will stay on pavement within the limits of the WTP. Both elements of the Project would not change the existing capacity of the treatment facility. Beneficiaries of the Project will be the WTP staff and CLAWA employees.

Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 1 (§15301), Class 2 (§15302), Class 3 §15303(d)
Reasons for Exemption
Class 1 Exemption – Existing Facilities. (§15301(c)) The asphalt rehabilitation component of the Project is categorically exempt from CEQA under the Class 1 exemption set forth in State CEQA Guidelines §15301 (c), which exempts the “…operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing r former use. Examples include but are not limited to: Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety).” The Project consists of the Rehabilitation of existing asphalt-paved access roadways, a parking area, and paved operational areas at CLAWA’s existing Silverwood Lake WTP. The work may include grinding and asphalt overlay, pavement removal and replacement, full-depth reconstruction, localized repairs, utility-trench pavement Repairs, and subgrade stabilization for the repair and maintenance of existing facilities that would generally maintain existing pavement elevations and would result in no expansion of the existing use. Class 2 Exemption – Replacement or Reconstruction (§15302) The asphalt rehabilitation component of the Project is also categorically exempt from CEQA under the Class 2 exemption set forth in State CEQA Guidelines §15302, which exempts the “replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced”. The Project consists of replacing or reconstructing existing asphalt-paved access roadways, the parking area, and paved operational areas at CLAWA’s Silverwood Lake facility. The improvements would be located on the same site, serve the same purpose and capacity as the existing pavement, and would not expand the existing use. Class 3 Exemption – New Construction or Conversion of Small Structures The new conduit component of the Project is categorically exempt from CEQA under the Class 3 exemption set forth in State CEQA Guidelines §15303, which exempts “the construction and location of limited numbers of new, small facilities or structures, installation of small new equipment and facilities in small structures; and the conservation of existing small structures from one use to another where only minor modifications are made in the exterior or the structure.” The Project includes installing two 4-inch-diameter PVC conduits extending approximately 315 linear feet to provide a sleeve for chemical injection tubing between two existing subsurface vaults. The alignment of the conduits is located where there is existing asphalt pavement slated for rehabilitation. Open trenching will be used for installation. Construction staging will stay on pavement within the limits of the WTP. The new conduit component of the Project does not meet any of the exceptions in State CEQA Guidelines §15300.2 (Exceptions to Class 3-6, and 11 Categorical Exemptions). The Project will not have cumulative impacts; there is no reasonable possibility that the Project will have a significant effect on the environment due to unusual Circumstances; the Project does not affect a designated scenic highway or historical resources; and it is not located on a hazardous waste site.

General Rule (§15061(b)(3))
Reasons for Exemption
General Rule – Review for Exemption (§15061(b)(3)) The Project is exempt from CEQA under the General Rule set forth in State CEQA uidelines §15061(b)(3)), which exempts Project using the “…common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” The Project is proposed within CLAWA’s existing Silverwood Lake WTP, specifically within the existing paved access roadways, parking area, and paved areas surrounding tanks and plant equipment. Since the Project proposes to rehabilitate previously developed and paved areas and install 315 lf of conduit within an already paved and disturbed location, there are no environmental resources present to be impacted by the Project. Since the Project is proposed within an area that has been previously disturbed/developed and would not increase the existing capacity or use of the facility, the Project is consistent with the exemption set forth in State CEQA Guidelines §15061(b)(3).
