Reasons for Exemption
Class 1 exemptions:
“Consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination…”
“…Examples include but are not limited to: (c) Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety).”
The project is located within an existing developed neighborhood roadway where pedestrians currently lack a continuous safe path of travel and must walk within the street. The proposed improvements will enhance pedestrian and ADA safety by closing gaps in the existing sidewalk network and installing ADA-compliant curb ramps and crossings. The project does not involve an expansion of existing use, as the surrounding neighborhood is already fully developed, and also is a similar-type facility for public safety
