Reasons for Exemption
The Board has determined that the adoption of Enforcement Order 2026-01 is exempt from CEQA under the Class 21, Enforcement Actions by Regulatory Agencies categorical exemption (California Code of Regulations, title 14, section 15321). Adoption of the Enforcement Order constitutes an administrative enforcement action requiring compliance with law, general rule, standard, or objective administered or adopted by the Board to address unauthorized encroachments within the State Plan of Flood Control. The order requires the submittal of a complete permit application for future review and approval but does not approve or authorize any ground-disturbing activity. The Board retains full discretion to consider environmental impacts and conduct any required CEQA review upon consideration of the permit application once submitted. Further, the Board has determined that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, title 14, section 15300.2 apply, as the adoption of the Enforcement Order itself would not result in a significant effect on the environment
