Reasons for Exemption
The proposed Project is categorically exempt pursuant to CEQA Guidelines Section 15305 (“Minor Alterations in Land Use Limitations), in that the proposed project consists of a request for a minor setback variance for fence and wall height, which would not result in the creation of a new parcel. Further, the Project also does not trigger any exceptions to categorical exemptions identified in CEQA Guidelines section 15300.2. in that: 1. Location. The proposed Project is not located on a project site which contains an environmental resource of hazardous or critical concern which would be designated, precisely mapped, and officially adopted pursuant to law by federal, state, or local agencies. 2. Cumulative Impact. The proposed Project will not result in a cumulative impact from successive projects of the same type in the same place, over time, as the Project is located on a site with an existing single-family home, and is consistent with the General Plan policies which were addressed in the General Plan Final EIR. 3. Significant Effect. As detailed in the Zoning Administrator staff report, dated August 25, 2026, no significant effects will occur as a result of the Project. The proposed Project will involve the installation of a 6’ security wall on the property, which will not negatively impact the project site. No unusual circumstances surround the Project which will result in a reasonable possibility of a significant effect on the environment. 4. Scenic Highways. The proposed Project will not damage scenic resources, including trees, historic buildings, rock outcroppings, or similar resources as none are located on the Project site. 5. Hazardous Waste Sites. The proposed Project is not located on a site as referenced in Section 65952.5 of the California Government Code. 6. Historical Resources. The proposed Project is not located on a site which contains a significant resource, and would not cause a substantially adverse change to the significance of a historic resource.
