Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-HUM-55081-R1C, pursuant to section 1602 of the Fish and Game Code to Michael McEnry. The Project is limited to six encroachments affecting unnamed tributaries to Little Larabee Creek. Work for all encroachments will include erosion control as necessary to minimize sediment delivery. Three encroachments are for water diversion from a Class II stream, for domestic use. Work for these water diversions will include facility retrofit/use, or decommission, using hand tools. One encroachment is to upgrade a stream crossing including realignment with the natural channel and restoration of the impacted area. Work for this encroachment will include excavation, removal of the existing culvert and trash, realignment and installation of a new culvert, backfilling and compaction of fill, rock armoring, and restoration of the unnatural channel per an approved restoration plan. One encroachment is for an on-stream pond spillway upgrade. Work for this encroachment will include excavation, removal of the existing perched culvert, reshaping the existing pond berm including excavation, backfilling, and compaction of fill, installation of a properly sized rock armored, open-channel spillway.

Reasons for Exemption
The project will permit the water diversion from Class II streams for domestic use using two existing private facilities and the removal of a third facility. Continued use of the two diversions at the specified rates and decommissioning of the third facility will not have substantial adverse impacts to species within the stream. The project authorizes road stream crossing upgrades and subsequent stream restoration and hydrological disconnection from road segments. The project authorizes spillway upgrades to an onstream pond to reduce impacts to the stream. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to California Code of Regulations section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
