Reasons for Exemption
The project meets the criteria set forth in CEQA Section 15061 (b)(3) (Common Sense Exemption), which states that CEQA only applies to projects which have the potential to cause a significant effect on the environment. The project is proposing to vacate two sewer easements that are no longer needed. The approval of this project would not result in additional physical impacts or development to the project site. The project is only a mapping action with no significant impact on the environment, and therefore, is not subject to CEQA. The project would also qualify to be categorically exempt from CEQA pursuant to Section 15305, Minor Alterations in Land Use Limitations. Section 15305 allows for the minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in
land use or density. The project is proposing a mapping action to vacate the existing sewer easements at a project site that has an average slope of less than 20%; this would not result in any changes in land use or density. The exceptions listed in Section 15300.2 would not apply in that no cumulative impacts were identified; no significant effect on the environment was identified; the project is not adjacent to a scenic highway; lastly, the project was not identified on a list of hazardous waste sites pursuant to Section 65962.5 of the Government Code.
