Document Description
The proposed Minor Use Permit (MUP) would permit the construction and installation of a 6-foot fence within the required front yard and along the secondary frontage. The increased fence height is requested to provide reasonable privacy and security while maintaining adequate sight lines and avoiding traffic safety impacts. The subject property is located at the terminus of a cul-de-sac within a private HOA development, where vehicular traffic is minimal and sight line constraints are not present. As such, the proposed fence height will not adversely affect visibility or circulation. Secondly, the proposed MUP would approve for a 25% reduction to the second-story rear yard setback from 20 feet to 15 feet in accordance with Section 42.4(i). A 25% reduction in rear setbacks allows for a more regularized building footprint that supports conventional vertical alignment of walls and load paths. This results in a more straightforward and constructible structural system without increasing overall site coverage or intensity of use.

Reasons for Exemption
Pursuant to California Code of Regulations Title 14, Division 6, Chapter 3, Article 19, Section 15303(e) Class 3 a “New Construction or Conversion of Small Structures” exemption will be applied to the proposed structure (fence) and setback reduction. This exemption does not fall under any of the exception categories outlined in section 15300.2. There are no historical buildings listed on the California Register of Historical Resources or on the County’s list of historical properties (verified with OHP). The property is not listed in the California Department of Toxic Substances Control “EnviroStor” database, and there are no toxic waste sites or facilities within 1,000 feet of the site. There are no Officially Designated State Highways according to the California Department of Transportation’s list. Due to the conclusions listed above, no cumulative impacts are expected.
