Reasons for Exemption
Pursuant to the California Environmental Quality Act (CEQA), the site improvement portion of the proposed project does not have a significant effect on the environment and is categorically exempt from the provisions of CEQA pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines that includes operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The improvements to the site would not expand the use and would only improve and minimally alter the existing use. Additionally, the project site is located in a fully developed and urbanized area that is not environmentally sensitive.
The restoration of up to 40 square feet of missing shingles at a designated cultural resource, the Hart House is also exempt pursuant to Section 15331 (Historical Resource Restoration/Rehabilitation) of the CEQA Guidelines that includes projects limited to the maintenance, repair, stabilization, rehabilitation, restoration, preservation, conservation, or reconstruction of historical resources in a manner consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties. The building within the park is considered a historical resource for the purposes of CEQA review, and the Certificates of Appropriateness approved for the project require the work to be consistent with the Secretary of Interior Standards for the Treatment of Historic Properties
