Implementation of the Plan will: (1) capping of eight (8) duct knockouts using hydraulic cement, (2) removal and backfill of an 11-foot-deep manhole using an approved Controlled Low Strength Material up to 8-feet and removal of the upper 3-foot manhole neck and native soil for the remaining 3-feet section, and (3) restore the levee to Title 23 standards as shown in the Plan

Reasons for Exemption
The Board has determined that the activities within the Board's authority are exempt from CEQA pursuant to the Class 21 (Enforcement Actions by Regulatory Agencies) categorical exemption (California Code of Regulations, title 14, section 15321), because the activity consists of actions taken by a regulatory agency to enforce applicable laws, regulations, and/or permit requirements. Specifically, the project implements a compliance action requiring the removal of an unauthorized manhole located on a project levee and restoration of the site to pre-disturbance conditions. The project is also exempt from CEQA pursuant to the Class 4 (Minor Alterations to Land) categorical exemption (California Code of Regulations, title 14, section 15304), because the activity consists of minor grading and restoration work involving backfilling the manhole and restoring the levee to pre-disturbance conditions. Restoring the existing site does not involve the removal of healthy, mature, scenic trees. The corrective action is limited in scope, occurs within a previously disturbed area, and will not result in a reasonable possibility of a significant environmental effect. The project is also exempt from CEQA pursuant to the Class 1 (Existing Facilities) categorical exemption (California Code of Regulations, title 14, section 15301), because the activity consists of the demolition and removal of accessory structures with negligible or no expansion of use. The Board further finds that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, title 14, section 15300.2 apply
