Notice of Exemption
Exempt Status
Ministerial
Type, Section or Code
Sec. 21080(b)(1); 15268(a)
Reasons for Exemption
Approval of this permit is not subject to CEQA because it is ministerial. The Air District's regulatory requirements that governed the approva l of this project did not allow for any subjective judgement related to whether or how the project may be carried out. The project complied with objective numerical standards in air
permitting/engineering reference materials. These fixed standards do not allow for or require any subjective judgment or discretion to interpret or apply. The Air District is legally compelled to approve the project where it complies with such standards. In addition, a Best Available Control Technology (BACT) determination was not required, since BACT was not triggered . Thus, the Air District's action was ministerial.
Exempt Status
Categorical Exemption
Type, Section or Code
§ 15301
Reasons for Exemption
Furthermore, the Air District's permit action is exempt under CEQA Guidelines §15301 because Gold Bond is an existing facility and the addition of the new bag house is a negligible expansion of use. A-29 Bag house emits less particulate matter emissions than the existing A-2 Baghouse.
The Air District reviewed the CEQA-related Information from the applicant indicating that there is no potential for a significant adverse environmental impact from the project. A formal health risk assessment was required and was approved by the Air District.
The Air District determined there are no unusual circumstances, or that the cumulative impacts from successive projects of the same type in the same place do not result in significant adverse environmental impacts.
