Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and
Streambed Alteration Agreement EPIMS Notification No. EPIMS-INY-60537-R6, pursuant to Section 1602 of the Fish and Game Code to Los Angeles Department of Water and Power.
The Project is limited to the construction of an approximately 120-foot-long by 16-foot-wide bioengineered bio-retaining wall that uses native and construction material to stabilize and reconstruct a portion of the Owens Riverbank. The bio-retaining wall will be constructed out of native, locally-sourced material including Bishop tuff, soil, coyote willow (Salix exigua) pole cuttings, and construction material including dead man anchors and a granular filter. The road atop the reconstructed bank will be repaired following construction of the bio-retaining wall.

Reasons for Exemption
On February 26, 2025, the Los Angeles Department of Water and Power, the Lead
Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, Section 15301, Class 1 and Section 15303, Class 3. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and
that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
