Document Description
Turning Leaf Organics (Applicant) is requesting to allow source separated vegetative food material, as defined by CalRecycle , and agricultural by-product material as additional allowable feedstocks at the existing Turning Leaf Organics Tulare Compost Facility located at 25948 Road 92, Tulare, California (APN 149-010-009 ), in the AE-40 (Exclusive Agriculture 40 Acre Minimum) Zone, within the Rural Valley Lands Plan, with the Land Use Designation of Valley Agriculture. The existing permit authorizes a solid waste recycling facility for commercial composting of dairy manure and green material. The proposed modification would allow the facility to accept compatible plant derived vegetative food material, including fruit and vegetable residuals, produce culls, trimmings, and similar pre-consumer organic materials, , as well as agricultural by-product material consisting of vegetative material with small amounts of naturally occurring nuts and oils and no added oils or other additives. No expansion of the approved facility footprint, operational area, or operational capacity is proposed.

Reasons for Exemption
This action is consistent with CEQA Guidelines Section 15301, Class 1, Existing Facilities, which consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures or facilities involving negligible or no expansion of existing or former use. In this instance, the proposal consists of a Minor Modification to Special Use Permit No. PSP 17-081 to allow source separated vegetative food material and agricultural by-product material as additional allowable feedstocks at the existing Turning Leaf Organics Tulare Compost Facility. The existing composting facility previously underwent environmental review through an Expanded Categorical Exemption approved by the Tulare County Planning Commission on April 11, 2018, by Resolution No. 9425. Therefore, the application of CEQA Guidelines Section 15301, Class 1, Existing Facilities, is applicable and appropriate for this project.
