Document Description
To authorize corrective work proposed in a Restoration Plan and Schedule (Plan) for Enforcement Case No. 2026-15776. Implementation of the Plan includes: (1) removing unauthorized sprinkler heads and a concrete stairway, (2) restoring the landside levee slope to pre-project conditions in compliance with California Code of Regulations Title 23, Waters, Division 1 (CCR Title 23), and (3) hydroseeding the landside levee slope. Restoration may include minor regrading, stabilization, and erosion control measures as necessary to ensure the integrity and function of the levee. No expansion of use or new development is proposed.

Reasons for Exemption
The Board has determined that the activities within the Board's authority are exempt from CEQA pursuant to the Class 21 (Enforcement Actions by Regulatory Agencies) categorical exemption (California Code of Regulations, title 14, section 15321), because the activity consists of actions taken by a regulatory agency to enforce applicable laws, regulations, and/or permit requirements. Specifically, the project implements a compliance action requiring the removal of an unauthorized stairway, sprinkler heads installed on the slope of a project levee and restoration of the site to predisturbance conditions. The project is also exempt from CEQA pursuant to the Class 4 (Minor Alterations to Land) categorical exemption (California Code of regulations, title 14, section 15304), because the activity consists of minor grading and restoration work involving backfilling and restoring the levee to pre-disturbance conditions. Restoring the existing site does not involve the removal of healthy, mature, scenic trees. The corrective action is limited in scope, occurs within a previously disturbed area, and will not result in a reasonable possibility of a significant environmental effect. The project is also exempt from CEQA pursuant to the Class 1 (Existing Facilities) categorical exemption (California Code of Regulations, title 14, section 15301), because the activity consists of the demolition and removal of accessory structures with negligible or no expansion of use. The Board further finds that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, title 14, section 15300.2 apply.
