Reasons for Exemption
The project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA, Public Resources Code §21000, et seq., and California Code of Regulations, Title 14, §15000, et seq.) pursuant to Section 15303 (Class 3 "New Construction or Conversion of Small Structures") and Section 15304 (Class 4 – “Minor Alterations to Land”) of the CEQA Guidelines due to the project consists of minor construction of a concrete pad and an accessible path of travel to accommodate an outdoor exercise park, together with minor alterations to the existing condition of the site. The project involves limited, small-scale improvements and would not result in significant environmental effects.
Moreover, the project also qualifies for a categorical exemption because none of the exceptions set forth in CEQA Guidelines Section 15300.2 apply. Specifically: (a) Location. The project site is not located within an environmentally sensitive area or an area containing an environmental resource of hazardous or critical concern that could be significantly affected by the project; and (b) Cumulative Impacts. The project, when considered in conjunction with successive projects of the same type in the same place over time, would not result in a significant cumulative impact; and (c) Significant Effects Due to Unusual Circumstances. There are no unusual circumstances associated with the project or project site that would create a reasonable possibility of a significant effect on the environment; and (d) Scenic Highways. The project would not result in damage to scenic resources within a highway officially designated as a state scenic highway; and (e) Hazardous Waste Sites. The project site is not included on any list compiled pursuant to Government Code Section 65962.5; and (f) Historical Resources. The project would not cause a substantial adverse change in the significance of a historical resource. Based on the foregoing, the project is categorically exempt from CEQA pursuant to CEQA Guidelines Sections 15303 and 15304, and no further environmental review under CEQA is required.
