Document Description
The California Department of Fish and Wildlife (CDFW) has executed Streambed Alteration Agreement EPIMS Notification Number SAC-65120-R2, pursuant to Section 1602 of the Fish and Game Code to the project Applicant, Chabad Jewish Community Center. The project is limited to the construction of a new 23,485-square-foot community center, an associated parking lot, and a fence on a 2.17-acre site. Construction of the community center (4,607 square feet) and the associated parking lot (3,619 square feet) involves the removal of the existing residence, removal of 6 riparian trees, and grading and paving outside of the bank of Willow Creek. The riparian trees range from dead to fair health, and their removal may involve excavation of the roots or leaving the stump.

Reasons for Exemption
On January 21, 2026, the City of Folsom, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, section 15183. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
