Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project involves minor alterations to an existing facility using power supplied from two existing on-site electrical substation for the installation of up to nineteen (19) electric vehicle charging stations and associated electrical, civil, and communications improvements to support (human operated) zero-emission cargo handling equipment including twenty (20) battery-electric terminal tractors and seven (7) battery-electric top handlers which will involve negligible alteration and no expansion of existing or former use of the site.

Section 15303 New Construction or Conversion of Small Structures (Class 3):
Reasons for Exemption
The Class 3 Categorical Exemption consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. To support the human operated battery-electric terminal tractors
and top-handlers as part of ongoing terminal operations, the project involves new construction and installations of up to nineteen (19) electric vehicle charging stations and associated electrical, civil, and communications improvements.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of Categorical Exemption CEQA Guidelines Section 15301 (Class 1. Existing Facilities) and Section 15303 (Class 3. New Construction or Conversion of Small Structures); therefore, the Project is exempt from CEQA and no further environmental review is required.
