Document Description
The proposed action authorizes the Chief Executive Officer to
execute the First Amendment to Contract HD-25-0156 with Charles King and Company in the not-to-exceed amount of $3,500,000
for a total contract value of $10,330,027.50 with a term ending March 16, 2027 for On-Call Services for Underground Wet Utilities
Equipment. The On-Call Services contract allows the Port to perform time-sensitive and specialized wet utility work, provides a
contracting resource for business continuity, and supplements capacity during peaks in workload beyond the Maintenance
Division's capacity. Additional funds are required to complete upcoming repairs throughout the Port of Long Beach. Work
conducted under this contract is funded from previously approved and budgeted operating funds.

The Class 1 Categorical Exemption consists of the operation,
repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical
equipment, or topographical features, involving negligible or no expansion of existing or former use. Amendment No. 1 increases
funding for upcoming repairs at existing Pump Station No. 3 and Pump Station No. 25, as well as ongoing wet utility maintenance,
with negligible or no expansion of existing or former use.

Reasons for Exemption
The Class 2 Categorical Exemption consists of
the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as
the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Work conducted
under the contract includes replacement of existing wet utilities infrastructure located on the same site with substantially the
same purpose and capacity as the infrastructure replaced.

Reasons for Exemption
The Class 3 Categorical
Exemption consists of construction and location of limited numbers of new, small facilities or structures; installation of small new
equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only
minor modifications are made in the exterior of the structure. Amendment No. 1 includes funding for construction of a new
waterline for the Pier B On-Dock Rail Support Facility Tidelands Toyota Fire Water Relocation Project, constituting installation of
small new equipment and facilities.

Section 15304 (Class 4. Minor Alterations to Land
Reasons for Exemption
The Class 4 Categorical Exemption consists of minor
public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature,
scenic trees except for forestry or agricultural purposes and backfilling where the surface is restored. Wet utilities work involves
trenching, excavation, and surface restoration within the existing footprint.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA)
Guidelines Section 15300.2 foreclose the use of Categorical Exemption CEQA Guidelines Section 15301 (Class 1. Existing
Facilities), Section 15302 (Class 2. Replacement and Reconstruction), Section 15303 (Class 3. New Construction or Conversion
of Small Structures), and Section 15304 (Class 4. Minor Alterations to Land); therefore, the Project is exempt from CEQA and
no further environmental review is required.
