The project is exempt from the California Environmental Quality Act (CEQA) based on: 1) CEQA Guidelines Section 15061 (b)(3) because approval of the solid waste franchise agreement can be seen to not have a significant effect on the environment; and 2) Section 15378(b)(4), which defines what is not a project under CEQA because the Town is setting a Franchise Fee for Town services, property, and facilities provided for solid waste services which involves a funding mechanism or fiscal activity within the meaning of the CEQA Guidelines and is, therefore, not a project.
