Reasons for Exemption
The Project has been environmentally reviewed pursuant to the provisions of the California Environmental Quality Act (Public Resource Code Sections 21000, et seq ("CEQA"), the state CEQA Guidelines (California Code of Regulations, Title 14, § 15000, et seq), and the environmental regulations of the City. The Project is categorically exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines Section 15301, Class 1. Class 1 applies to projects involving the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, involving negligible or no expansion of existing or former use. The proposed Project involves the addition of alcohol sale and service to an existing restaurant within an existing commercial building and commercial plaza and involves no expansion of the building footprint beyond the existing area. Therefore, the project is exempt from CEQA under a Class 1 Categorical Exemption and no additional environmental review is required.
