Reasons for Exemption
The project is exempt from the California Environmental Quality Act under two categorical exemptions. The construction of the perimeter wall, ceremonial entry gate, and moon gate is exempt as a Class 3 Categorical Exemption (CEQA Guidelines Section 15303(e), New Construction or Conversion of Small Structures), which expressly includes accessory structures such as fences and walls. The fascia remodel, exterior repainting, and interior refresh of the existing buildings are exempt as a Class 1 Categorical Exemption (CEQA Guidelines Section 15301, Existing Facilities), consisting of minor alterations to existing private structures involving negligible or no expansion of the existing use.
The exception at CEQA Guidelines Section 15300.2(t) is not implicated. The subject property is outside the National Register Marysville Historic Commercial District and is not itself a listed resource. No physical alteration of the adjoining Hop Sing Society building or any other listed resource is proposed; the new wall and gates are freestanding structures on the subject parcel, reversible in nature, and designed-,- as discussed in the Analysis below - to be compatible with, and to enhance the cultural setting of, the adjacent historic resources of Chinatown. No further environmental review is required.
