Reasons for Exemption
The City's Environmental Administrator has determined that the Project is exempt from further environmental review because approval of an Affordable Housing Disposition and Development Agreement (AHDDA) to facilitate the Project is covered by the same exemption that applies to the overall Project. Specifically, the Project, including adoption of a resolution approving the AHDDA, is statutorily exempt from further environmental review because the sale and development of the Property is for a 100% affordable housing development Project. State CEQA Guidelines Section 15194 provides that CEQA does not apply to any development project that (a) meets the threshold criteria set forth in State CEQA Guidelines, Section 15192, (b) is on a site that is not more than five acres in area, (c) meets certain location criteria, and (d) involves the construction of 100 or fewer units that are affordable to low-income households that will be deed restricted to ensure continued availability as housing units for lower income households for a period of at least 30 years at monthly housing costs deemed to be “affordable rent” for lower income, very low income, and extremely low income households as determined pursuant to Section 50053 of the Health & Safety Code. Because the Project satisfies each of these criteria, it qualifies for the statutory exemption for affordable housing projects. No further environmental review of the Project is required.
