Reasons for Exemption
CEQA Guidelines Section 15301 provides that projects involving Existing Facilities, are exempt from the requirement to prepare CEQA documentation. More specifically, the Class 1 Categorical Exemption consists of: “the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use.” This Project falls within the definition of a Class 1 Categorical Exemption because it consists of the maintenance and permitting of an existing commercial tenant space, and it involves negligible or no expansion of use. Additionally, this project satisfies the requirements of CEQA Guidelines Section 15311. Section 15311 applies to “the construction or placement of minor structures accessory to existing commercial, industrial, or institutional facilities. These projects are considered to have no significant environmental impact and include items like on-premise signs.” As this project is for the installation of an on-premise sign, the Class 11 Categorical Exemption applies
