Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The Port will issue a Level I HDP for minor alteration of existing facilities to remove existing grass landscape involving negligible or no expansion of existing or former use.

Reasons for Exemption
The Class 2 Categorical Exemption consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The project involves replacing existing grass landscape with drought-tolerant landscaping, in accordance with Assembly Bill 1572. All items that are removed from the site will be disposed of in a manner that meets all federal, state and local environmental and regulatory requirements.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of Categorical Exemption CEQA Guidelines Section 15301 (Class 1. Existing Facilities) and Section 15302 (Class 2. Replacement or Reconstruction); therefore, the Project is exempt from CEQA and no further environmental review is required.
