Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 1 (Sec. 15301 - Existing Facilities) and Class 3 (Sec. 15303 - New Construction of Small Structures).
Reasons for Exemption
Class 1 (Sec. 15301) applies because the project adds standby backup power to an existing electrical service at an existing facility with negligible or no expansion of the facility's use. Class 3 (Sec. 15303) applies because the generator, propane tank, and concrete pads are minor new equipment and small structures. None of the exceptions in CEQA Guidelines Sec. 15300.2 apply: the site is existing developed ground with no unusual circumstances, and although located in a fire hazard area, the propane tank and generator were reviewed and permitted by the Kern County Fire Department, the installation meets NFPA 58 clearances and separation requirements, and the backup emergency system will not result in a significant effect on the environment.
