Reasons for Exemption
This project is subject to review under the California Environmental
Quality Act ("CEQA"), however, it is exempt pursuant to Section 15308 of the CEQA Guidelines, and Section 15301. As set forth above, the Los Angeles County department of Public Works is responsible for all operation and maintenance activities of the City's sewer collection system. The City is not responsible for any operation, maintenance or construction activities related to the system. Further, the plan does not explicitly commit the City to future construction or maintenance activities. Pursuant to Section 15308 of the CEQA Guidelines, actions taken by regulatory agencies to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment, are exempt from CEQA. Under the instant circumstances, the SSMP is mandated by the State Water Board to minimize future sewer system overflows in the City, thereby reducing water quality issues that could pose serious health and safety issues. Given that the SSMP is adopted for the purpose of protecting the environment, it is exempt under Section 15308. Further, because the SSMP applies to an existing sanitary collection system, and its implementation may result in the repair or replacement of existing systems involving negligible or no expansion of capacity, the SSM P is exempt from CEQA pursuant to Section 15301 of the CEQA Guidelines.
