Reasons for Exemption
Section I 5269(a) exempts projects for maintaining, repairing, restoring, demolishing, or replacing property damaged in a disaster area where a state of emergency is declared by the Governor under the California Emergency Services Act, starting with Section 8550 of the Government Code. This includes projects that remove, destroy, or alter historical resources posing an imminent threat to public safety or adjacent property, or those determined by the State Office of Historic Preservation under Section 5 028(b) of the Public Resources Code. The proposed project involves in-kind repair and rehabilitation of existing roadway and replacement of culverts damaged by the September 2020 Bear Fire (part of the North Complex Fire), covered under the Presidential Major Disaster Declaration (FEMA-4558-DR-CA) and the State of California's emergency proclamations in 2020.
